Terms & Conditions

These Terms & Conditions govern the use of the Harrington & Vale website and the purchase of products from our online store.

Please read these Terms & Conditions carefully before placing an order.

By using our website or placing an order with Harrington & Vale, you agree to be bound by these Terms & Conditions, together with any other policies that apply to your purchase.

Nothing in these Terms & Conditions is intended to exclude, restrict or replace any rights you have under applicable UK consumer law.

2. Using Our Website

You may use our website for lawful personal and non-commercial purposes, including browsing our products and purchasing goods.

You must not:

  • use our website for unlawful or fraudulent purposes;
  • attempt to interfere with the security or proper operation of the website;
  • attempt to gain unauthorised access to our website, systems or accounts;
  • introduce viruses, malicious software or other harmful material;
  • misuse our website or services;
  • use automated systems to access or extract website content in a manner that is unlawful or materially interferes with our services; or
  • use our intellectual property except as permitted by law or with our permission.

We may take reasonable action to protect our website, customers and business where we identify suspected fraud, security threats or misuse.

3. Product Information

We take reasonable care to ensure that product descriptions, photographs, measurements, sizing information, prices and other information displayed on our website are accurate.

Please review the product description and available sizing information before placing your order.

Product images are provided to represent the products as accurately as reasonably possible. However, colours and appearance may vary slightly depending on lighting, photography, screen settings and the device being used.

Minor differences that arise solely from display settings do not alter your statutory rights.

Goods supplied by us must comply with the requirements of applicable UK consumer law, including applicable requirements relating to satisfactory quality, fitness for purpose and conformity with their description.

4. Product Availability

All orders are subject to product availability.

Placing an item in your shopping basket does not reserve that item.

If we are unable to supply an item after you have placed an order, we will contact you as soon as reasonably possible.

Where payment has already been taken for an item that we cannot supply, the relevant amount will be refunded.

5. Prices

Prices available to UK customers are displayed in pounds sterling (£).

The price applicable to your order will be shown during checkout before you place the order.

We may change prices from time to time. Changes will not normally affect orders for which a contract has already been formed.

We take reasonable care to ensure that prices are displayed accurately.

If an obvious pricing or technical error occurs, we may contact you before accepting or fulfilling the affected order. We will not knowingly rely on an obvious error to mislead a customer about the price of a product.

6. Placing an Order

Before placing your order, please check:

  • the products selected;
  • size and colour;
  • quantities;
  • delivery information;
  • contact information; and
  • the total amount payable.

By completing checkout and placing an order, you are making an offer to purchase the selected goods.

After your order has been submitted, you will receive an electronic acknowledgement or confirmation.

An automated acknowledgement that we have received your order does not necessarily mean that we have accepted it where further verification is reasonably required.

A contract for the purchase of goods will be formed when we accept your order in accordance with the order process communicated to you.

7. Our Right to Refuse or Cancel an Order

We may refuse or cancel an order where we have a legitimate reason to do so, including where:

  • a product is unavailable;
  • payment cannot be authorised;
  • we reasonably suspect fraud or unauthorised activity;
  • delivery cannot reasonably be completed using the information provided;
  • there is an obvious pricing or website error; or
  • accepting or fulfilling the order would breach applicable law.

If we cancel an order after payment has been taken and the goods will not be supplied, we will refund the amount due.

Nothing in this section affects your statutory rights.

8. Payment

The payment methods currently available will be displayed during checkout.

You must be authorised to use the payment method provided for your purchase.

By placing an order that requires payment, you authorise the relevant payment to be processed for the amount shown at checkout.

Payment transactions may be processed by third-party payment service providers.

9. Order Processing

Orders are normally processed within 1–2 business days following successful payment confirmation.

Processing time refers to the period required to prepare an order before it enters the delivery network.

Processing time is separate from the estimated delivery time.

10. Delivery

Harringtons & Vale provides free standard delivery on all orders.

Our estimated standard delivery time is:

5–10 business days after order processing.

Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control.

Where tracking is available, tracking information will be provided after your order enters the delivery network.

Orders containing multiple products may occasionally be delivered in separate parcels.

Please see our Shipping & Delivery Policy for further information.

11. Delivery Information

You are responsible for providing complete and accurate delivery information when placing your order.

If you discover an error in your delivery address, please contact Customer Care as soon as possible.

We will make reasonable efforts to assist before the order has progressed too far through processing or delivery. However, we cannot guarantee that delivery information can be changed once processing or dispatch has begun.

This does not affect any rights you may have where a delivery problem is attributable to us rather than incorrect information provided by you.

12. Delivery Delays

Occasionally, delivery may be delayed by circumstances outside our reasonable control, such as disruption within delivery networks, customs procedures, severe weather, public holidays or other significant logistical events.

If we become aware of a significant problem affecting your order, we will take reasonable steps to assist you.

Nothing in this section removes or restricts your statutory rights concerning delivery.

13. Your Right to Cancel an Online Purchase

UK consumers purchasing goods online generally have a statutory right to change their mind and cancel the contract without giving a reason.

You must inform us of your decision to cancel within 14 days of receiving the goods.

After informing us that you wish to cancel, you then have a further 14 days to return the goods.

Please contact our Customer Care team before returning an item so that we can provide the appropriate return instructions.

Full details are contained in our Returns & Refund Policy.

14. Change-of-Mind Return Costs

Where you exercise your cancellation right simply because you have changed your mind, including where you would prefer a different size or colour, you are responsible for the direct cost of returning the goods.

Please follow the return instructions provided by our Customer Care team.

15. Size and Colour Changes

We do not offer direct exchanges where the correct product was supplied but you would prefer another size or colour.

In these circumstances, you may return the original item in accordance with our Returns & Refund Policy and place a new order for your preferred size or colour.

This does not affect your rights where we supplied an incorrect, faulty, damaged or misdescribed product.

16. Faulty, Damaged, Incorrect or Not-as-Described Goods

If goods supplied to you are faulty, damaged, incorrect, not as described or otherwise fail to conform to the contract, please contact Customer Care.

We may reasonably request information, including photographs where appropriate, to help us identify and resolve the problem.

Where we are responsible for the problem, you will not be required to bear the necessary cost of correcting it.

Where appropriate, we may arrange for the correct item or a replacement to be supplied without additional cost to you.

Depending on the circumstances, you may also have statutory rights to other solutions, including a refund, repair, replacement or price reduction.

Nothing in these Terms restricts those statutory rights.

17. Care of Goods Being Returned

Please take reasonable care of goods that are to be returned to us.

This applies both to change-of-mind returns and to goods being returned because they are faulty, damaged, incorrect or not as described.

Items should, where practicable, be securely packaged to prevent avoidable damage during return transit.

Please do not deliberately damage, alter, wash or continue to use an item unnecessarily after identifying a problem with it.

If an item was faulty, damaged, incorrect or not as described when supplied, your statutory rights will not be affected merely because you reasonably handled or tried on the item in order to inspect it or discover the problem.

Harrington & Vale is not responsible for separate damage subsequently caused by misuse, deliberate damage, improper care or other actions by the customer that are unrelated to the original fault or non-conformity.

18. Refunds

Refunds are handled in accordance with our Returns & Refund Policy and applicable UK consumer law.

Where a refund is due following a valid cancellation and return, it will be processed without undue delay and within the applicable statutory time limit.

Refunds will normally be made using the same payment method used for the original transaction, unless otherwise expressly agreed and permitted by law.

We will not require you to accept store credit where you are legally entitled to a monetary refund.

19. Promotions and Discount Codes

From time to time, we may offer promotions, discounts or promotional codes.

Additional terms may apply to a particular promotion and will be communicated with the relevant offer where appropriate.

Promotional codes may not be combined unless expressly stated.

We may withdraw or change future promotional offers, but doing so will not remove rights already acquired under a completed purchase or otherwise affect your statutory rights.

20. Intellectual Property

The Harrington & Vale name, branding and original website content, including text, graphics, designs and other materials owned by or licensed to us, are protected by applicable intellectual property laws.

You may access our website for personal use.

You must not reproduce, distribute, commercially exploit, modify or otherwise use protected Harrington & Vale content without permission, except where such use is permitted by law.

Nothing in these Terms claims ownership over intellectual property belonging to third parties.

21. Third-Party Services

Our website may use or provide access to services operated by third parties, including payment, delivery, technology or other service providers.

Where you interact directly with a third-party service, additional terms or privacy practices may apply.

The use of third-party service providers does not remove any responsibility that Harrington & Vale cannot lawfully exclude in relation to its contract with you.

22. Website Availability

We aim to keep our website accurate, secure and available.

However, access may occasionally be interrupted for maintenance, security, technical problems or circumstances outside our reasonable control.

We may reasonably update, modify or temporarily suspend parts of the website where necessary.

Nothing in this section limits liability or consumer rights that cannot lawfully be excluded.

23. Events Outside Our Reasonable Control

We will not be responsible for a delay or failure to perform an obligation where and to the extent that it is caused by circumstances outside our reasonable control.

Where such circumstances affect an existing order, we will take reasonable steps to minimise disruption and assist the customer.

Nothing in this section excludes obligations or statutory consumer rights that cannot legally be excluded.

24. Our Responsibility to You

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or restrict liability for fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Your statutory rights as a consumer remain unaffected.

25. Personal Information

We handle personal information in accordance with our Privacy Policy and applicable UK data protection law.

Please read our Privacy Policy for information about how personal information is collected, used, disclosed and protected.

26. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal requirements.

Changes will apply prospectively.

The terms applicable to an order will generally be those provided to you when the relevant contract was formed, subject to any changes required by applicable law.

27. Severability

If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

28. Your Statutory Rights

These Terms & Conditions are intended to operate alongside, rather than replace, your statutory consumer rights.

Nothing in these Terms & Conditions excludes, restricts or limits rights or protections that cannot lawfully be excluded under applicable UK consumer law.
